Cruel and Inhumane Treatment
Cruel and inhumane treatment includes mental or physical abuse. There is no uniform standard, and each case stands on its own merits. In some cases, drug or alcohol abuse may not be considered cruel and inhumane treatment unless it can be demonstrated the drug or alcohol abuse became violent and abusive. If you believe you are victim of cruel and inhumane treatment and are seeking a divorce, please contact JONES & MORRIS, Attorneys at Law. We also represent individuals accused of cruel and inhumane treatment in divorce actions.
Alienation of Affection - Adultery
Allegations of adultery are complex. One spouse cannot testify against the other, so adultery must be proved in other ways. In addition, there may be several defenses to adultery even if it is established; including forgiveness, consent and establishing both spouses are committing adultery. We represent men and women in divorces where adultery is being alleged. Contact JONES & MORRIS, Attorneys at Law today to discuss your case.
Abandonment
The grounds for divorce based on abandonment must demonstrate the one spouse left without justification or consent for over one year with no intent of ever returning. If you believe you have grounds for a divorce based on abandonment, or if you have been served divorce papers alleging abandonment, contact JONES & MORRIS, Attorneys at Law; we can help.
One Year Legal Separation
A formal separation document must be entered into and filed with the court. There is specific language or formalities that must be included in order to give rise to a divorce after one year. You should consult an experienced family law attorney to ensure your separation agreement includes all the necessary language and addresses all the necessary issues.
